1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Vetta BV ("Company," "we," "us," or "our"). By accessing or using the Vetta application and website (collectively, the "Service"), including joining our waitlist or using an activation code, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not use the Service.

2. Service Description

Vetta is an AI-powered educational pet health companion designed to provide general information about dog health and wellness. The Service allows users to:

  • Chat with an AI trained on veterinary literature
  • Create and maintain health records for their dogs
  • Track health-related reminders and appointments
  • Store and organize health documents and notes
  • Receive general educational information about dog health topics

3. Waitlist and Early Access

Vetta may offer a waitlist and invitation-based early access program. By joining the waitlist, you provide your email address and consent to receiving communications about the Service and your activation status.

Activation Codes: Access to the Service may require an activation code issued by us at our sole discretion. Activation codes are personal, non-transferable, and may be single-use or multi-use as specified. We reserve the right to revoke, expire, or limit activation codes at any time without prior notice.

No Guarantee of Access: Joining the waitlist does not guarantee access to the Service. We may limit the number of early-access users at our discretion.

4. Important Disclaimer: NOT a Veterinary Service

VETTA IS NOT A VETERINARY SERVICE AND DOES NOT PROVIDE VETERINARY ADVICE, DIAGNOSIS, OR TREATMENT.

Vetta provides educational information about dog health for informational purposes only. The AI generates responses based on general knowledge and should not be relied upon for medical decisions. If your dog is ill or injured, you must always consult a licensed veterinarian for professional medical advice, diagnosis, and treatment.

The information provided by Vetta is not a substitute for professional veterinary care. We strongly encourage you to maintain a relationship with a qualified veterinarian and seek professional medical attention for any health concerns affecting your dog.

5. Eligibility

You must be at least 16 years old to use the Service. By using Vetta, you represent and warrant that you are at least 16 years of age and have the legal capacity to enter into this agreement. If you are under 16, you may not use the Service.

6. User Accounts and Responsibilities

You may create an account using email and password or through a supported social sign-in provider (Google, Apple). You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access to your account
  • Ensuring that information you provide is accurate and up-to-date
  • Keeping your activation code confidential and not sharing it with others unless it is designated as a multi-use code

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or unlawful activity, including the misuse or unauthorized sharing of activation codes.

7. Free Tier and Paid Subscriptions

Vetta offers both a free tier and paid subscription plans. The free tier allows you to use basic features with certain limitations. Paid subscriptions provide access to premium features as described at the time of purchase.

We reserve the right to modify the features available in the free tier or paid subscriptions at any time. Any changes to paid features will not affect active subscriptions retroactively.

8. Fair Use Policy

Certain subscription plans, including the Pro tier, offer unlimited or enhanced access to AI-powered features. This access is subject to a fair use policy designed to ensure reliable service for all users.

What "unlimited" means: You may use the AI chat and related features as much as you need for your personal or professional veterinary practice. There is no fixed daily or monthly cap on conversations.

What is not permitted:

  • Automated, scripted, or bot-driven usage (e.g., sending messages via API scripts or browser automation)
  • Reselling, sub-licensing, or providing access to third parties as a commercial service
  • Systematically extracting or scraping AI-generated content for use outside the Service
  • Using a single account to serve multiple distinct veterinary practices or businesses

How we handle unusual usage: If your usage significantly exceeds typical patterns (for example, more than 10 times the median usage among Pro subscribers), we may reach out to discuss your needs. We will not suspend or restrict your access without first contacting you and providing a reasonable opportunity to adjust usage or upgrade to a custom plan.

We reserve the right to update this fair use policy. Changes will be communicated with at least 30 days' notice.

9. Payment Terms

Billing and Charges: If you purchase a paid subscription, you authorize us to charge the payment method you provide. Billing occurs at the frequency you select (monthly or annual). All charges are in EUR unless otherwise specified.

Payment Processing: Payments are processed by Stripe, our third-party payment processor. We do not store your full payment card information. By providing payment information, you agree to Stripe's terms of service.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months or early cancellation.

Renewal and Auto-Billing: Subscriptions automatically renew at the end of each billing period unless you cancel. You are responsible for canceling your subscription if you wish to discontinue service.

Price Changes: We reserve the right to change subscription prices with 30 days' notice. Price changes do not take effect until the start of your next billing cycle.

10. Acceptable Use Policy

You agree not to:

  • Use the Service to harass, threaten, or abuse others
  • Attempt to gain unauthorized access to the Service or systems
  • Transmit malware, viruses, or other harmful code
  • Scrape, crawl, or automatically extract content from the Service
  • Use the Service for commercial purposes without authorization
  • Violate any applicable laws or regulations
  • Reverse-engineer, disassemble, or decompile the Service
  • Create multiple accounts to circumvent usage limits
  • Share your account with others for payment evasion
  • Share, sell, or distribute activation codes unless explicitly permitted

Violation of this policy may result in immediate suspension or termination of your account and revocation of any activation codes.

11. Intellectual Property

Vetta Content: All content provided by Vetta, including text, images, software, code, and AI-generated responses, is the intellectual property of Vetta BV or our licensors. You may not reproduce, modify, or distribute this content without permission.

Your Content: You retain ownership of any content you create within the Service (such as health notes and dog profiles). By using the Service, you grant us a license to store, process, and use your content to provide the Service, improve our Service, and comply with legal obligations.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VETTA SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profit, data, or use
  • Any health decisions or outcomes resulting from the use of information provided by Vetta
  • Medical complications or adverse effects to your dog
  • Errors or omissions in AI-generated responses

Your sole and exclusive remedy for dissatisfaction with the Service is to discontinue use of the Service. To the extent permitted by law, our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

  • Merchantability or fitness for a particular purpose
  • Accuracy, completeness, or reliability of information
  • That the Service will be uninterrupted or error-free
  • That defects will be corrected
  • That the Service is free from harmful components

14. Indemnification

You agree to indemnify, defend, and hold harmless Vetta BV, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service or violation of these Terms
  • Your violation of applicable laws or regulations
  • Your content or violation of third-party rights
  • Any health decisions made based on information from Vetta

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law principles. Any legal action or proceeding arising from these Terms shall be exclusively brought in the courts of Belgium.

If you are a consumer resident in the European Union, you also enjoy the protection of the mandatory provisions of consumer protection law applicable in your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the website, and your continued use of the Service constitutes acceptance. For material changes, we will notify registered users by email at least 30 days in advance. We recommend reviewing these Terms periodically for updates.

17. Termination

We may suspend or terminate your account and access to the Service at any time, for any reason, including violation of these Terms. This includes the right to revoke activation codes and remove users from the waitlist. Upon termination, your right to use the Service immediately ceases. You remain responsible for any charges incurred before termination.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid.
